ASSAY is a trading name of Functional Consumer Products Ltd, registered in England and Wales.

These Terms of Service (“Terms”) apply when you visit, browse or make a purchase from our online store at shop.assaynutrition.com and use the products, features and services available through it.

Our online store is hosted by Shopify, which provides the ecommerce platform that allows us to sell our products to you.

By using our website or placing an order, you agree to these Terms together with our:

Product packaging or appearance may occasionally vary slightly from images displayed online, for example because of packaging updates or differences in screen display.

Any such changes will not affect an order that we have already accepted unless we contact you and agree otherwise.

Nothing in these Terms limits your rights where goods are faulty, not as described or otherwise fail to meet the standards required by law.

When you place an order through our website, you are offering to purchase the products shown in your order.

After placing an order, you should receive an acknowledgement confirming that we have received it. This does not necessarily mean that your order has been accepted.

A contract between you and us is formed when we confirm that your order has been accepted or dispatched.

We may decline or cancel an order where there is a reasonable reason to do so, for example where:

  • a product is unavailable;

  • there is an obvious pricing or listing error;

  • payment cannot be authorised;

  • we reasonably suspect fraudulent activity;

  • delivery is not available to your location; or

  • the order breaches a reasonable purchase restriction disclosed on our website.

If we cancel an order after you have paid, we will refund the relevant amount.

6. Prices and Payment

Prices displayed on our website are shown in the currency indicated at checkout.

The total amount payable, including any applicable delivery charges and taxes, will be shown before you confirm your order.

We may change our prices from time to time, but changes will not affect orders that we have already accepted.

If we discover an obvious pricing error before accepting your order, we may contact you to give you the option of purchasing the product at the correct price or cancelling the order.

Payment is processed through the payment methods available at checkout.

We do not store your full payment card details ourselves.


7. Shipping and Delivery

We will deliver your order to the delivery address you provide during checkout.

If an order is delayed, lost or damaged in transit, please contact us so that we can investigate and provide an appropriate resolution.

9. First Order Guarantee

Where offered, our First Order Guarantee is subject to the conditions set out in our Returns & Refunds Policy.

If you are not happy with your first qualifying ASSAY order, contact us within the period specified in that policy and we will work with you to make it right.

Depending on the circumstances, this may include a replacement, store credit or refund.

The First Order Guarantee is an additional commercial benefit and does not affect your statutory rights.


10. Product Information and Responsible Use

Please read the product label, ingredients, directions for use and any warnings before using our products.

Products should be used in accordance with the directions shown on the packaging or product page.

Information provided on our website about nutrition, ingredients and product characteristics is provided to help customers understand our products.

It is not intended to replace professional medical advice where such advice is appropriate.

Our online store is hosted by Shopify.

Shopify provides the ecommerce technology used to operate the store, but your contract for the purchase of ASSAY products is with Functional Consumer Products Ltd, not Shopify.

Questions, returns and complaints relating to products purchased from us should therefore be directed to ASSAY.

We process personal information in accordance with our Privacy Policy:

We are not responsible for losses that were not reasonably foreseeable when the contract was made.

If you are purchasing as a consumer, we are not responsible for business losses such as loss of profits, revenue or business opportunity arising from your personal use of our products or website.

We will not be responsible for delay or failure to perform an obligation where this is caused by circumstances genuinely outside our reasonable control.
